What is the time limit for filling after accident happened. C.A?

I was injured on the job a year ago working as a personal care taker/driver, didn't do anything about it, thought it would go away by itself, didn't , now my neck is hurting more and more, can i still be filling. What is the time limit in California?.

You mean, for workers compensation? All workers comp losses are supposed to be reported to the department of labor and industry within 3 working days, and should have been reported to your supervisor immediately.





If you didn't report it to your boss at the time, you're not likely to be able to do anything now about it. Let me rephrase: you can file a claim, but it will probably be denied. It's really hard to prove an injury that happened a year ago, when it wasn't bad enough to treat back then. It will be VERY easy for the insurance company to defend a denial - because LOTS AND LOTS of stuff could have happened between then and now.
Reply:The statute of limitations for a workers compensation claim should be around two years from the date of the accident.





If you didn't report it at the time, expect your employer to fight.
Reply:Dpends what policy you're covered. if it is while driving... it is 6 months after the policy has expired. And for Workers Compensation, it is 3 years after the time of accident.
